Terms & Conditions

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. If you are under the age of legal digital consent in your jurisdiction, you may only use the Service with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

Carvac suggests short road-trip ideas, points of interest, weather and driving directions based on inputs you provide. Suggestions are generated with the help of AI and third-party data sources and are provided for general informational purposes.

Safety. You are responsible for assessing the suitability and safety of any destination, activity, route, or recommendation. Carvac does not guarantee that recommendations are safe, open, accessible, legal, or appropriate for every user or circumstance. Always check road conditions, weather, local restrictions, physical requirements and your own abilities before travelling.

Emergencies. Carvac is not intended for emergency situations and should not be relied upon where immediate or critical information is required. In an emergency, contact your local emergency services.

Accuracy. Information such as opening hours, pricing, weather, accessibility, ratings, fuel costs and availability may change without notice. You should verify important information directly with the relevant business, venue, or authority before relying on it.

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for activity under your account. You must notify us promptly at carvacescape@gmail.com if you believe your account has been accessed without your authorisation, your password has been compromised, or you notice any other suspicious activity on your account.

You must not:

• use the Service for any unlawful, fraudulent, harmful or abusive purpose;
• infringe anyone's intellectual property, privacy or other rights;
• upload, transmit or introduce malicious code, viruses, worms, or other harmful software;
• attempt to overload, flood, disrupt, degrade or impair the Service or the servers or networks connected to it;
• use automated systems, bots, crawlers or scrapers to access the Service without our prior written permission;
• attempt to access, tamper with, or use another user's account, credentials or data;
• probe, scan or test the vulnerability of the Service, or breach or circumvent any security or authentication measures;
• resell, sublicense or commercially redistribute the Service or its output without our written consent;
• attempt to reverse engineer or circumvent technical limits, rate limits or paywalls;
• use the Service to generate content that is illegal, sexually explicit, hateful, deceptive or that targets minors.

Paid subscriptions to Carvac+ are sold by Hamish Feroz Clay and the order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders, which means Paddle processes your payment, handles billing, applicable taxes (including GST/VAT), invoicing and currency conversion, and provides customer service inquiries and returns. By purchasing, you authorise Paddle to charge your payment method for the selected plan.

Payment, billing, tax, invoicing and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.

Subscriptions renew automatically at the end of each billing period (monthly or yearly, as selected) at the then-current price until cancelled. You can cancel at any time from the in-app "Manage subscription" button, which opens Paddle's customer portal; cancellation stops future renewals. Refunds are handled under our Refund Policy.

Trip suggestions, descriptions and recommendations are generated with the assistance of AI models and third-party data and may be inaccurate, incomplete or out of date. Carvac is not a travel advisory and the output is not professional advice. You are solely responsible for how you use it, including verifying details and complying with local laws.

You must not submit prompts or content that is illegal, infringing, abusive, sexually explicit, targeted at minors, or designed to jailbreak or misuse the Service. We may filter, refuse, remove or moderate prompts and outputs at our discretion.

Carvac and all software, branding, design and documentation that make up the Service are owned by Carvac and its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use within your chosen plan.

You retain any content you submit (such as saved spots). You grant Carvac a worldwide, royalty-free licence to host, process and display that content solely to operate the Service for you.

The Service relies on third parties including Google Maps Platform, OpenStreetMap, Open-Meteo, AI providers, Lovable Cloud and Paddle. Your use of those features is also subject to those providers' terms.

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue parts of the Service at any time.

We may suspend or terminate your access immediately if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our acceptable-use rules. You may close your account at any time by contacting us. On termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Notice.

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Carvac does not warrant that trip suggestions are accurate, safe, legal or suitable for any particular journey.

To the fullest extent permitted by law, Carvac will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or business, arising from or related to the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid for Carvac+ in the 12 months preceding the claim, or AUD $50, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded by law, including non-excludable consumer guarantees under the Australian Consumer Law.

You agree to indemnify and hold Carvac harmless from claims, damages and expenses arising from your breach of these Terms, your misuse of the Service, or content you submit.

These Terms are governed by the laws of Queensland, Australia. Disputes will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia, without prejudice to mandatory consumer-protection rights in your country of residence.

The Service lets you submit content such as saved spots, suggested locations, reviews, comments, photos, and other materials ("User Content"). You are solely responsible for the User Content you submit. By submitting User Content, you represent and warrant that:

• you own the User Content, or otherwise have all rights, licences, consents and permissions necessary to submit it and to grant the licence in these Terms;
• the User Content does not infringe or violate any third-party right, including intellectual property, privacy, publicity, or contractual rights;
• the User Content is not illegal, defamatory, obscene, hateful, harassing, threatening, misleading, or otherwise objectionable, and does not depict or target minors inappropriately;
• the User Content does not contain personal data of another person shared without their consent, or any confidential information you are not authorised to share.

We may review, moderate, refuse, edit, remove or disable access to any User Content at any time, with or without notice, if we reasonably believe it breaches these Terms or is otherwise harmful. We are not obligated to monitor User Content and do not endorse any User Content submitted by users.

Carvac will not be liable for any failure or delay in providing the Service, or for any loss or damage, caused by events beyond our reasonable control. These include but are not limited to: internet or telecommunications outages; failures, downtime or degradation of cloud, hosting or payment providers; power failures; cyberattacks; natural disasters; fire, flood or extreme weather; pandemics or epidemics; strikes or labour disputes; and acts, orders or restrictions of any government or regulatory authority.

We may update these Terms from time to time. Material changes will be reflected on this page with a new "last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
